Olivenhain Oktoberfest

Ticket terms and conditions. Last updated September 2026. The version of these terms posted at the time of your purchase governs that purchase.

1. Agreement and acceptance

All ticket holders (“You”) acknowledge that by purchasing, receiving, or using a ticket for the Olivenhain Oktoberfest 2026 (the “Festival”), You have fully read this agreement, are entering into it voluntarily, and agree that it binds You, all members of Your party attending the Festival, and Your heirs, executors, administrators, and representatives. If You do not agree to these terms, do not purchase a ticket and do not enter the Festival.

“OTC” means the Colony of Olivenhain Town Council. “OTC Parties” means OTC together with its affiliates and each of their respective representatives, officers, directors, owners, members, trustees, agents, employees, volunteers, successors and assigns, and the Festival's sponsors and vendors, including their respective management, agents, staff and designees.

2. Assumption of risk

You understand that attending the Festival involves inherent risks, including but not limited to uneven and unpaved ground, outdoor heat and sun exposure, crowds, food and beverage service, the consumption of alcohol by others, live amplified music, vehicle traffic and parking areas, and contact with other attendees. You voluntarily and expressly assume all such risks, known and unknown, whether or not described here, and accept sole responsibility for any injury, illness, loss, or damage You may suffer.

3. Release and indemnity

You hereby indemnify, defend, and hold harmless the OTC Parties from any loss, liability, damage, or cost in any way arising out of or related to Your actions and omissions at, around, or while traveling to and from the Festival.

You hereby waive, discharge, hold harmless, and covenant not to sue the OTC Parties from any and all liability arising out of or in connection with the Festival, including any claims, causes of action, obligations, lawsuits, charges, complaints, controversies, damages, costs, or expenses of whatsoever kind, nature, or description arising out of or related to the Festival, Your attendance at the Festival, or Your travel to and from the Festival, including those caused by the ordinary negligence of the OTC Parties.

Nothing in this agreement releases, limits, or waives liability for gross negligence, recklessness, willful or wanton misconduct, fraud, or any violation of law, to the extent such a release, limitation, or waiver is prohibited by California Civil Code section 1668 or other applicable law.

You expressly waive the protections of California Civil Code section 1542, which provides: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that if known by him or her would have materially affected his or her settlement with the debtor or released party.”

4. Minors, parents, and guardians

Attendees under 18 must be accompanied and supervised at all times by a parent or legal guardian. By purchasing or providing a ticket for a minor, You represent that You are that minor's parent or legal guardian, or are authorized to act on their behalf, and You agree to this entire agreement on the minor's behalf, including the assumption of risk, release, and indemnity provisions above. You agree to indemnify the OTC Parties for any claim brought by or on behalf of that minor. OTC does not provide childcare or supervision of any kind.

5. Alcohol and attendees under 21

Individuals under 21 years of age are prohibited from purchasing, possessing, or consuming alcohol on any OTC or affiliated property. Any attendee who breaches this prohibition, and any attendee who knowingly furnishes alcohol to someone under 21 at the Festival, will be ejected without refund.

Alcohol is served only in the designated beer and wine garden by servers holding current California Responsible Beverage Service certification, under an active ABC permit for the day of the Festival. Servers will refuse service to anyone who appears intoxicated and to anyone unable to produce valid photo identification.

Your ticket does not provide unlimited alcoholic drinks. The number of drinks available depends on donations made by breweries and wineries and is limited at the discretion of OTC and event staff. The limit may be confirmed on the day of the Festival, and is typically four (4) alcoholic drinks per ticket. You are encouraged to consume alcohol in moderation and to be aware of standard drink sizes and the alcohol content of what You are drinking. Anyone who over-consumes or appears to over-consume alcohol will be ejected from all Festival activities without a refund.

6. Identification, wristbands, and drink tickets

Valid government-issued photo identification is required to receive a 21-and-over wristband. The wristband must be worn and visible to be served. Wristbands are non-transferable, and any wristband that has been removed, altered, or tampered with is void. Lost or damaged wristbands will not be replaced. Drink tickets have no cash value, are valid only on the day of the Festival, are non-refundable, and expire unused at the close of the event.

7. Conduct, prohibited items, and inspection

OTC reserves the right to refuse admission to, or to reject or remove, any person without refund, including for conduct that OTC deems unsafe, disruptive, or unbecoming. Outside alcohol, glass containers, weapons of any kind, drones, grills, and open flames are prohibited. Pets are prohibited, other than service animals as defined by the Americans with Disabilities Act. The Festival grounds are smoke and vape free. By entering, You consent to inspection of Your bags, coolers, and containers as a condition of entry.

8. No campaigning or political activity

The Meeting Hall and grounds are private property, and OTC is a 501(c)(3) organization that maintains a strict non-political stance. OTC enforces a strict no campaigning policy at its festivals. You voluntarily agree not to engage in any promotional, political, or campaign-related activity during the Festival, including but not limited to wearing or displaying campaign apparel, hats, or buttons, distributing flyers or literature, displaying signs or table materials, circulating petitions, and canvassing, polling, or soliciting attendees. OTC may require that such material be removed or put away, and may eject any person who does not comply, without refund.

9. Tickets, membership, and the volunteer discount

Your ticket is a revocable license that may be withdrawn and admission refused at any time. Tickets may not be duplicated. Unlawful resale or attempted resale of a ticket is grounds for seizure and cancellation without compensation. A ticket may not be used for advertising, promotions, contests, or sweepstakes unless OTC gives formal written authorization, and even then any use of OTC's trademarks or other intellectual property remains subject to OTC's consent.

Member-priced tickets require an OTC membership that is active as of the day of the Festival, and OTC may verify membership at the gate. The volunteer discount requires completion of the volunteer shift You signed up for, applies to one adult ticket, and is not transferable or combinable with other offers.

10. Refunds, cancellation, and force majeure

There are NO refunds on tickets for any reason. All sales are final.

If the Festival is cancelled in whole or in part due to a Force Majeure Event, You will not be entitled to a refund. Notwithstanding the foregoing, OTC may issue, at its sole and absolute discretion, a partial or full refund of Your ticket, accounting for, among other considerations, the extent and nature of the cancellation.

A “Force Majeure Event” means an act of God, act of terrorism, flood, fire, wildfire, public health emergency, hurricane, tsunami, earthquake or other natural disaster, war, strike or other labor condition or dispute, an order or injunction of any court or administrative body or any other act of public authority, severe weather or air quality conditions threatening the safety of Festival attendees, utility or water failure, or any similar contingency or unexpected event beyond OTC's reasonable control. You understand that in all instances the maximum remedy You may receive for the cancellation of any part of the Festival, if any, is the face value of Your ticket, excluding all fees and service charges paid in connection with the purchase.

OTC may change the Festival's schedule, program, entertainment, menu, beverage selection, layout, or capacity at any time without notice, and no such change entitles You to a refund.

11. Photography and likeness

Your ticket is issued on the condition that, outside of means provided on olivenhain.org, You shall not transmit or aid in transmitting any description, account, picture, or reproduction of the Festival. You expressly grant the OTC Parties the right to use Your image, voice, and likeness in connection with any live or recorded transmission or reproduction of the Festival, and in OTC's promotional and archival materials, without compensation. Photographs and recordings You take during the Festival may be used for personal purposes only. No commercial or political use is permitted.

12. Personal property, parking, and health

OTC is not responsible for personal property that is lost, stolen, or damaged at the Festival, including items left unattended and items in or on vehicles. Parking is at Your own risk. Food is prepared and served in an outdoor environment and may come into contact with common allergens. OTC cannot guarantee that any item is free of a particular allergen, so please ask staff before consuming if You have a food allergy or dietary restriction.

13. Accessibility and questions

We want everyone to enjoy the Festival. The grounds are historic and partly unpaved, so please contact us in advance at support@olivenhain.org with accessibility questions or requests and we will do our best to accommodate them.

14. General

This agreement is governed by the laws of the State of California, without regard to its conflict of laws rules, and You agree that any dispute arising out of or relating to the Festival or this agreement shall be brought exclusively in the state or federal courts located in San Diego County, California. If any provision of this agreement is held unenforceable, that provision shall be modified to the minimum extent necessary or severed, and the remaining provisions shall remain in full force and effect. OTC's failure to enforce any provision is not a waiver of it. This agreement, together with the ticket description at the time of purchase, is the entire agreement between You and OTC regarding the Festival.
